1. About Wellbeing by PS
Welcome to Wellbeing by PS (“we,” “us,” “our”). These Terms & Conditions (“Terms”) govern your use of our website, platform, services, corporate wellbeing packages, and all associated content (“Services”). By accessing or using the Services, all users, including companies, administrators, and resource users agree to be bound by these Terms.
If you do not agree with these Terms, please do not use our Services.
2. Definitions
– “Company Client” – An organisation that purchases a wellbeing package or training from Wellbeing by PS.
– “Resource User” – An employee, contractor, or individual who is granted access to sessions or resources under their employer’s wellbeing package.
– “Provider” – A therapist, coach, trainer, or other qualified professional delivering support sessions or training.
– “Sessions” – Prepaid wellbeing appointments (30-minute or 50-minute) purchased by the Company Client and booked by Resource Users.
– “Platform” – The Wellbeing by PS website and booking system.
3. Eligibility & Access
3.1 Companies
Company Clients must enter a service agreement and pay for a wellbeing package before Resource Users can access Services.
3.2 Resource Users
Resource Users may access only the services included within their employer’s prepaid wellbeing package. Access ends when a package expires or when the Company Client withdraws access.
3.3 Confidentiality
Company Clients cannot see:
which Resource Users access support
what sessions are booked
any personal, mental-health, or wellbeing information
Companies may only see usage totals, not identities.
4. Booking & Use of Sessions
4.1 One Session at a Time
Resource Users may only book one wellbeing session at a time.
They may book their next session only after completing the previous one.
4.2 Provider Choice
Resource Users may select, change, or rotate between Providers at any time.
4.3 Session Availability
Sessions are subject to Provider availability. We do not guarantee appointments on specific dates.
5. Cancellation & No-Show Policy
5.1 Employer-Funded Sessions
Employers are charged for all sessions booked through their wellbeing package.
5.2 Late Cancellation or Missed Sessions
If a Resource User:
– cancels with less than 24 hours’ notice, or does not attend the session
– the Company Client will still be charged the full session fee.
5.3 Resource User Responsibility
Resource Users understand that Wellbeing by PS is not responsible for paying for missed, late, or unattended sessions.
6. Validity Period of Wellbeing Packages
All wellbeing packages purchased from Wellbeing by PS have a 12-month validity period from the date of purchase unless otherwise agreed in writing.
Unused sessions expire at the end of the validity period and are non-refundable.
7. Providers & Scope of Support
7.1 Independent Professionals
All Providers are independent professionals, not employees of Pineapple Support Society or Wellbeing by PS.
We are not liable for the clinical decisions, actions, or advice of Providers.
7.2 Ethical Standards
Providers must:
– act within the laws and licensing rules of their jurisdiction
– maintain confidentiality
– follow ethical duty-of-care requirements
provide clear boundaries around what constitutes support
7.3 No Crisis or Emergency Support
Wellbeing by PS does not provide crisis support, emergency intervention, or urgent care.
If you are in danger or in a crisis, you must contact local emergency services immediately.
8. Transition or Termination of Support
Providers may end a support relationship according to ethical guidelines.
If a Resource User wishes to move to a new provider, Wellbeing by PS will assist when possible.
After prepaid sessions are completed, Resource Users may continue privately with a provider at their own cost.
9. Intellectual Property Rights
All website content, trainings, materials, videos, branding, and written content are owned by Wellbeing by PS / Pineapple Support Society and protected by copyright, trademark, and international IP laws.
Users may not:
– copy, distribute, or reproduce any content
– resell or republish materials
– use branding without express permission
Limited use is granted solely for participation in training or accessing Services.
10. User Conduct & Prohibited Use
Users may not:
– impersonate any person or company
– attempt to access restricted data or accounts
– share login credentials
– harass Providers or staff
– interfere with or disrupt the platform
– use the Services for illegal activities
– misuse sessions (e.g., for crisis, non-work-related consultations, or inappropriate behaviour)
Violations may result in immediate termination of access.
11. Privacy & Data Protection
Data is handled according to the Pineapple Support Privacy Policy and relevant data-protection laws (GDPR, CCPA, etc.).
Companies cannot access personal data from Resource User sessions.
Resource User information is shared only with their provider, not with their employer.
12. Payment & Refunds
– All invoices must be paid prior to session access.
– Packages are non-refundable once activated.
– Expired or unused sessions are non-refundable.
13. Service Availability & Platform Updates
We may update or change the Platform at any time.
Content may not always be complete or up to date.
We are not responsible for downtime, outages, or provider unavailability.
14. Third-Party Links
Our website may contain links to external sites.
We do not endorse or assume responsibility for third-party content.
15. Disclaimers
– Services are for wellbeing support, not emergency care.
– No information on the website or platform constitutes medical or legal advice.
– Wellbeing by PS and Pineapple Support Society are not liable for provider actions, technical issues, or user misuse.
16. Limitation of Liability
To the fullest extent permitted by law:
– Wellbeing by PS is not liable for damages arising from use of the Services.
– Liability shall not exceed the amount paid by the Company Client for the relevant package.
– We are not liable for emotional, indirect, or consequential damages.
17. Indemnification
Company Clients and Resource Users agree to indemnify and hold harmless Wellbeing by PS from any claim arising from:
– misuse of the Services
– breach of these Terms
– interactions with Providers
– unlawful behaviour
18. Governing Law
These Terms are governed by the laws of:
Delaware, USA, and applicable federal laws.
19. Changes to These Terms
We may update these Terms at any time.
Continued use of the Services constitutes acceptance of the updated Terms.
